| dc.description.abstract | En este comentario se analiza la STSJ de la Sala de lo Social de la Comunidad Valenciana, de 23 de septiembre de 2025, en la que se aborda el alcance que, desde una vertiente subjetiva, debe darse al complemento para la reducción de la brecha de género sobre una pensión contributiva, valorándose si dicho complemento ha de tener como personas beneficiarias únicamente a las personas progenitoras por el cuidado de hijos/as, de filiación natural o adoptiva o, si por el contrario, el ámbito subjetivo de este complemento admite una interpretación amplia y, en consecuencia, puede extenderse también a otras personas que ante la imposibilidad de la adopción y por medio la figura del acogimiento familiar, acreditan el correspondiente cuidado y dedicación al menor o a la menor. | |
| dc.description.abstract | This commentary analyzes the STSJ of the Social Chamber of the Valencian Community, dated September 23, 2025, which addresses the scope that, from a subjective perspective, should be given to the supplement for reducing the gender gap on a contributory pension, assessing whether said supplement should only have as beneficiaries parents for the care of children, of natural or adoptive filiation or, on the contrary, the subjective scope of this supplement admits a broad interpretation and, consequently, can also extend to other people who, in the face of the impossibility of adoption and through the figure of family foster care, prove the corresponding care and dedication of the minor. | |
