Catalan disability law passed in 2011 emphasizes the natural capacity of disabled and aged people aiming at respecting their personal and family autonomy. In this context, the institution of Asistencia or Amministrazione di sostegno is defined as a protective measure for people that both incapacitation and related protective mechanisms developed by the legal system, are not possible or advisable. This article analizes the new institution comparing the Catalan regulation with Italian civil law.
